In 1813, Arkansas County was founded as the southernmost part of the Missouri Territory. It was among the initial five counties that existed when Arkansas Territory was established in 1819. The extent of their jurisdiction may differ across counties; however, circuit courts generally handle criminal, naturalization, and significant civil cases. Chancery courts oversee matters related to equity, divorce, probate, and adoption. County courts preside over juvenile, tax, claim, and county financial cases. Justice of the peace courts handle preliminary criminal and minor contract cases. These records are typically available from the establishment of the county, unless they were lost due to fire or other causes. Although records of the former courts of common pleas from the territorial period no longer exist, the county clerk’s office is responsible for maintaining records of all active courts within the county. It is essential to verify the specific procedures followed in each county due to variations in jurisdiction. The Family History Library (FHL) has microfilmed numerous county court records. County Clerk has probate records from 1809 and marriage records from 1838; Clerk Circuit Court has land records, divorce and court records from 1803 and military discharge records from 1917.
